3. Purpose of the website and terms of use
This website provides general information about the Firm, its professionals, practice areas, track record and ways to get in touch. These terms govern access to, navigation of and use of its content, without prejudice to any mandatory rules that apply.
Access to the public information on the site is free of charge, without prejudice to the connection costs charged by the user's communications provider. Accessing the site is not the same as engaging legal services and does not mean accepting a quote, proposal or professional engagement.
Users must use the site lawfully, diligently and with respect for third-party rights. Nothing in this notice reduces the rights that the law mandatorily grants to consumers and users.
4. Informational nature of the content
The texts, service descriptions, references to legislation and other materials on this website are for general information and professional outreach. They may refer to rules that have since been amended and do not replace a professional's assessment of the facts, evidence, deadlines and circumstances of each case.
The Firm endeavours to keep the content up to date, but does not undertake to update every informative reference permanently. The dates of publications should be taken into account when assessing whether they are still current.
No procedural, administrative, contractual or other action should be taken or omitted relying solely on the general content of this website. Anyone who needs advice on their situation should request a specific professional assessment.
5. Enquiries, professional relationship and conflicts of interest
Browsing the website, sending the form, writing an email, calling, or receiving a preliminary reply does not, in itself, mean that an engagement has been accepted or that a lawyer-client relationship has been established. That relationship arises when the Firm expressly accepts the engagement and the applicable professional requirements are met.
Before accepting a matter, the Firm may request the information needed to identify the prospective client and the parties involved, check for conflicts of interest, assess the viability of the request and meet its legal and ethical duties. Receiving that information does not mean taking on the defence of any party.
The Firm retains the professional right to accept or decline a matter in accordance with the applicable rules. A lack of reply to an enquiry should not be interpreted as acceptance of an engagement.
6. Deadlines, urgent communications and filing of documents
The contact form is a channel for first contact. It is not a procedural, administrative or notarial register, nor a channel authorised for formal notifications, and it must not be used to interrupt limitation or expiry periods, file appeals or ensure that documents subject to a deadline are received.
In urgent matters or those subject to a deadline, interested parties must use the legally appropriate channels and obtain express confirmation that the Firm has accepted the engagement before relying on it to act. The published opening hours are for information only and do not imply permanent availability.
7. Confidentiality and professional secrecy
The practice of law is subject to a duty of professional secrecy. Even so, the ordinary contact channels of this website are intended for a first approach: they must not be used to send medical records, specially protected data, complete case files or banking documents without first receiving instructions from the Firm on the appropriate channel.
Where sensitive documents need to be exchanged, the Firm will indicate a communication and identity verification system suited to the matter. Users should check the recipient's address and avoid sending information about third parties that is not necessary or that they are not entitled to share.
8. Fees and quotes
The content of this website is not a binding contractual proposal, an individual quote or a public offer of fees. The scope of the service, the responsible professional, fees, expenses, any advance payments and the other terms are communicated and agreed, where applicable, by means of a proposal, an engagement letter or another legally valid means.
Before an engagement is formalised, the pre-contractual information required for the type of client and the way the service is contracted will be provided, including, where applicable, the legal regime for distance contracts with consumers. This website does not allow services to be contracted or paid for online.
9. User obligations and prohibited uses
Users undertake not to access restricted areas, servers or systems without authorisation; not to carry out denial-of-service attacks or introduce malicious code; not to impersonate others; and not to use the form to send unlawful, misleading or automated messages, or messages unrelated to its purpose.
They may also not alter or circumvent the technical measures by which the site operates, or extract or exploit its content in an automated way where this infringes the law or the rights of the owners. The Firm may take proportionate technical measures against abusive use, without prejudice to any legal action that may be appropriate.
10. Intellectual and industrial property
The intellectual and industrial property rights over the texts, visual identity, designs, photographs, logos and other content of this website belong to Asesoramiento Jurídico Martín Antón y Asociados, S.L. or to third parties who have authorised their use. The fact that content is openly accessible does not imply a general assignment of rights.
Consulting and personal use are permitted to the extent the law allows. Any reproduction, exploitation or transformation not covered by a legal exception requires the owner's authorisation. The right of quotation and the other legal limits will always be respected.
The map on the Contact page is an image created with data from OpenStreetMap (© OpenStreetMap contributors, ODbL licence), styled with OpenFreeMap and with data from OpenMapTiles. Third-party names and distinctive signs that appear on the website belong to their owners, and mentioning them does not imply sponsorship, partnership or endorsement.
11. References to cases, results and clients
References to practice areas, experience or rulings are descriptive and are not a commitment to obtain a similar result in other matters: each case depends on its own circumstances, the evidence and the decision of the competent bodies.
Identifiable references to clients or to information protected by professional secrecy are only disclosed where there is sufficient legal cover and the rules on data protection, confidentiality and professional ethics are respected.
12. Availability, security and liability
The owner takes reasonable measures, according to the means available, to keep the site running and secure. Interruptions may occur because of maintenance, updates, technical incidents, failures of third-party services or circumstances beyond its control.
The Firm endeavours to provide clear and correct information and may correct any inaccuracies it detects. To the extent permitted by law, it is not liable for interruptions or incidents that are not attributable to it.
Nothing in this notice excludes liability for wilful misconduct or negligence, for breach of contractual or professional obligations, or liability arising from consumer rights, data protection or any other case in which the law does not allow liability to be limited.
13. Links to other websites
The website may contain links to legislation, professional bodies, public administrations and other third-party sites, including the link to Google Maps from the Contact map. The Firm does not control their content or their privacy or cookie policies, and including a link does not mean endorsing their services. When users leave this website, they should read the terms of the destination site.
Anyone wishing to link to this website must do so to its home page or to specific pages without presenting it in a misleading way or suggesting a commercial or professional relationship that does not exist.
14. Data protection and cookies
The processing of personal data is governed by the Privacy policy, and the use of cookies and similar technologies by the Cookie policy.
15. Fraudulent communications
If you receive unusual communications asking for confidential documents, passwords, changes of payment account or transfers, check their authenticity through a Firm channel you already know, such as the telephone number published on this website. This warning is preventive and does not replace the security obligations or the responsibilities that the law assigns to each party.
16. Changes
The Firm may amend this notice to adapt it to changes in legislation, case law, its organisation or the website. The version in force is the one published on this page, with its update date. Changes do not retroactively affect contractual terms already agreed.
17. Governing law and jurisdiction
Use of this website is governed by Spanish law, without prejudice to any mandatory protective rules that apply. Disputes will be submitted to the courts determined by the legal rules on jurisdiction, including the mandatory forums for consumers and users where applicable. This notice does not establish a territorial submission that deprives users of the rights granted by mandatory rules.
18. Language
This English version is provided for convenience only. In case of any discrepancy, the Spanish version prevails.
